How we can help you with children law issues

Our children law solicitors can help you with a wide range of children issues, including all of those related to divorce and relationship breakdown.

  • Child custody

When getting divorced or separating, deciding where your children will live is usually a top priority. You can agree this between yourselves voluntarily, or ask a judge to decide if you cannot reach an amicable agreement. We can support you through negotiating a voluntary agreement, or represent you in court as required, ensuring your rights and your children’s best interests are protected.

  • Child visitation and contact

If one parent has sole custody, it is important to decide how often the other parent will be able to visit and contact them. We can help you negotiate a fair visitation and contact agreement, or support and represent you if you have been denied visitation and contact, or believe that your former partner should be denied visitation and contact to protect your children.

  • Child maintenance

Working out on-going financial arrangements for your children is essential to ensure their long-term security. We can help you negotiate how much maintenance you or your partner will pay, or take the matter to court, if required. We can also represent you in court if your partner fails to pay child maintenance or if you need to vary an existing child maintenance arrangement.

  • Child protection

If you are concerned that your former partner represents a danger to your children, we can apply for court orders to prevent them contacting your children and you. We are able to take swift action in such situations, ensuring your family’s safety is protected.

Our children law dispute resolution service

We can take a variety of different approaches to resolving disputes involving children issues and will advise you on which is most appropriate for your situation and goals.

  • Mediation

When making arrangements for your children, it is usually desirable to maintain the best possible relationship with your former partner. This can make it easier to continue co-parenting together and is generally better for your children’s emotional wellbeing.

Mediation allows you to agree childcare solutions in a non-confrontational way, with you and your former partner sitting down with a trained, neutral mediator who can talk through the issues and priorities and guide you to a mutually acceptable solution.

  • Collaborative law

Collaborative law offers another non-confrontational option, where you and your ex-partner both have the benefit of your own solicitor to ensure your best interests and those of your children are protected. Collaborative law involves both parties and your solicitors having a four-way meeting where you can negotiate arrangements for your children without the need for court proceedings.

  • Court action

If you and your ex-partner cannot agree arrangements for your children, we can help you apply for a court order, allowing a judge to decide what is best for your children.

If you have voluntarily agreed arrangements for your children, we can apply for a Consent Order to make this agreement legally binding. This gives you security against the possibility of your partner later changing their mind about the arrangements.
