Standard of Living

This is a tricky area for family lawyers when trying to sort out financial settlements at the end of a divorce. Recently cases have focused very much on the standard of living that a departing spouse is to enjoy which is not guaranteed in the future. There is a move towards an objective of eventual independence, with particularly women having to face comments from judges about becoming more self-sufficient after the divorce. It all depends on the length of the marriage, the actual standard of living enjoyed, but less emphasis is now being placed on what the couple enjoyed when together than perhaps the desire to achieve eventual total independence.
